Oral Arguments

It must contain

1. 01Written arguments already filed — Rule 2(3A) puts them before the oral hearing, not after.
2. 02The issues, taken in order, and answered.
3. 03The record cited by reference: which affidavit, which paragraph, which exhibit.
4. 04The authorities you rely on, and a fair account of those against you.
5. 05An argument that fits the time the court allows — Rule 2(3B)–(3C) let the court fix limits.

Where it fails

• Reading the written arguments aloud, which spends the hearing on what the court already has.
• Raising a case not pleaded, not made an issue, and not put in cross-examination.
• Leaving the strongest point until the time has run out.
